Dumas Police Department Sgt. Jamie Donaldson and PTL Crystal Martin were dispatched to 1050 Northview Street in reference of someone breaking into a car, according to a September 30, 2020 Police Report.
Donaldson and Martin were en route to the address when dispatcher Alan Hernandez advised he was still on the phone with the complainant. The complainant described the person as a black male wearing a red hoodie and has a beard.
The complainant stated the subject was on a bicycle heading toward Patrick Dr then towards Collins Street. He also stated the male threatened him and tried to attack him when he confronted the subject.
Sgt. Donaldson and Officer Martin searched the area for the subject. As Officer Martin approached May Dr. and Bowles Street, the officer saw a black male wearing a gray shirt riding a bicycle and a red hoodie was tied around the bike frame. The suspect turned onto May Dr. passing Officer Martin who identified the suspect as Joseph Livingston.
Officer Martin turned around and activated her lights to stop Mr. Livingston. Speaking with Mr. Livingston, Officer Martin asked him did he just come from Northview Street area and he stated, “No, I'm just riding around.” Officer Martin asked Mr. Livingston if he had any weapons and he stated, “No, nothing but a black handled pocket knife. Mr. Livingston pulled the knife out of his right back pocket for Officer Martin to see. Upon patting down Mr. Livingston left front pocket, Officer Martin asked Mr. Livingston what was in the pocket and he stated it was a mini radio. Officer Martin pulled the item out and it was a black/silver TOM-TOM GPS device.
Officer Martin asked Mr. Livingston was the device his and he stated Yes. Officer Martin also asked Mr. Livingston that if she takes him back to Northview Street, will the person tell me he was the one that broke into their car and he stated No.
Officer Martin transported Mr. Livingston back to the scene.
Upon arrival, Officer Martin made contact with the complainants Dickie Webb and Jodie Webb. Martin asked Mr. Webb if he was able to identify the person and he said yes, 100 percent.
Mr. Webb was escorted to Officer Martin's patrol car where Mr. Livingston was placed in the backseat. Mr. Livingston had put his mask on but Mr. Webb identified Mr. Livingston as the person who went into their car, threaten him and tried to attack. Officer Martin asked Mr Livingston to take off his mask which he did and Mr. Webb 100 percent identified Mr. Livingston again. Mr. Livingston was place under arrest.
Officer Martin also asked Mr. Webb was there damage to the vehicle and he stated No, the vehicle was unlocked.
Mr. Livingston was transported to Dumas Jail and booked in for Breaking and Entering, Terroristic Threatening and Theft of Property.
Sgt. Donaldson transported Mr. Livingston's bicycle with the red hoodie attached to the Dumas PD. The GPS Device, Red Hoodie and pocket knife has been entered into Dumas Evidence Locker. Photos have been taken.
